How to Get Back Taxes Forgiven

How to Get Back Taxes Forgiven

The IRS Back Tax Forgiveness Programs

If you need help with your back taxes please call 407-344-1012, or go to www.freedomtaxaccounting.com

If you are someone interested in knowing how to get back taxes forgiven, bear in mind that the IRS will never completely forgive the back taxes. Your back taxes can, however, be minimized and settled by acting upon several other methods. So how to get back taxes forgiven if the IRS does not believe in the royal pardon? There are certain programs through which a taxpayer can have the back taxes “reduced” which can be used synonymously with “forgiven” in this context. In order to know which back tax forgiveness program best fulfills your requirements, have a look below at the various tax forgiveness programs that are available.

1.    Penalty Abatement

If you are interested in knowing how to get back taxes forgiven, then Penalty Abatement is one of those methods. A reasonable cause will determine whether the IRS will adjust the interest and penalties assessed to the back taxes of the taxpayer. So the taxpayer will have to petition a justifiable genuine cause when filing for the abatement of penalty. The following rationales justify as a reasonable cause:

  • Being Jobless

  • Decline in the income

  • Serious health troubles

  • Invincible forces of nature

  • Death of a close family member

  • Divorce

  • Poor tax advice

  • Delay or error by the IRS

  • Erroneous written advice given by the IRS

All those people who are looking forward to know how to get back taxes forgiven, and are willing to get facilitated by the penalty abatement, must know that they will only get a single chance to petition. Yes, the one and only. So what does that mean? It means that you will have to be pretty good with your solitary attempt so that you are not denied. Inexperienced taxpayers are bound to fail so it is imperative that you acquire the services of a qualified and experienced IRS tax preparer or professional to assist you with the petition of Penalty Abatement.

How to File for Penalty Abatement?

You can use either one of the following methods to file for penalty abatement:

  1. Over the telephone or in a meeting

  2. Filing a petition

  3. Submitting Form 843 with a petition

For detailed instructions for Form 843, visit this website.

2.    Currently Non-Collectable Status

If you are deliberating on how to get back taxes forgiven, then depicting a non collectable status can also assist you in this regard.  If you fulfill some or all of the conditions specified below, you might just qualify to attain the non collectable status:

  • You have an extremely low reasonable collection potential

  • Your assets are not worthy enough

  • Your assets are inaccessible

  • You are unemployed with no source of other income

  • Your only way of earning is through the benefits yielded from social security and welfare

  • You have little money remaining after the payment of rent, groceries and other utilities

But what does this mean and how does it get back taxes forgiven? You see, if you justify your reasons well enough, you will not have to make any additional payments to the IRS apart from the estimated tax payments or current withholdings, that is, no past taxes are due. The main advantage of currently non collectable status is that the IRS will not levy your bank account, will not compel the individual to enter into an installment agreement or withhold your wages. If your status remains currently non collectable for the duration of the statute of limitations, it is possible that you will not have to pay anything to the IRS at the end and your back taxes are forgiven.

When will the currently non collectable status end?

The time duration varies from one person to another. The status is directly proportional to the monthly income earned by the individual. If a person qualifies the currently non collectable status, the IRS agent inserts a closing code in the account of the taxpayer. The code will determine when the files of the tax payer will have to be reviewed again. If you start earning sufficient income after some years, then you will have to start paying the back taxes. The currently non collectable program is particularly helpful because it allows the taxpayers to stand on their feet until they overcome their financial hardships.

So if you are really curious about knowing how to get back taxes forgiven, learning more about currently non collectable status will prove to be considerably helpful.

How to file for currently non collectable?

All those people who want to know how to get back taxes forgiven and are considering the option of currently non collectable status, they will have to gather the necessary documents:

  • Bank statements for the last three months

  • Proper listing of the assets with the market value

  • Mention their living expenses and income

  • Evidence of any self managed medical payments

After this you will have to fill in the Form 433-A or Form 433-F. Review the form by consulting the IRS manual for financial analysis to understand the nuances for assistance.

3.    Partial Payment Installment Agreement

One of the reasons why people wanting to learn how to get back taxes forgiven should consider installment payment is that it will keep the IRS off your backs. It projects a positive image and depicts your willingness to cooperate and prevent the IRS from taking further action against you. You qualify for a partial installment agreement when your reasonable collection point is greater than what will qualify you for a currently non collectable status. This means that you will have to pay some amount each month to the IRS rather than not paying anything at all. So how does this benefit you? Well, you will not have the entire back tax forgiven but what this will do is that it will appease the IRS into accepting lesser amounts till the remaining duration of the collection period. Like the currently non collectable, the partial payment installment will give you time to reach a stage where you can file a bankruptcy, or surpass the collection time period which may help in getting the back taxes forgiven entirely. But the disadvantage with this method is that your interests will keep accruing. However, all those people interested in finding out how to get back taxes forgiven must know that negotiating the installments is difficult because the IRS will try to get as much as possible from you. You can discover more about the partial payment installment by visiting the IRS website

Let's move on to the procedure of how to form an LLC in Florida. This section will carefully detail out everything you need to know about setting up an LLC in Florida. Forming a Limited Liability company in Florida is a great choice, if you are looking for reduced tax liability, flexible tax management structures, and of course limited liability for your members and managers. Also, according to the federal government, Florida is one of the best states for forming a business. If you wish to know how to form an LLC in Florida, then you will have to plan out your business properly, complete the tax requirements, file the relevant documents with the Department of State, and maintain the annual reporting.

For more info on how to form LLC in Florida...go to www.freedomtaxaccounting.com

We will be exploring the answer to the question how to form an LLC in Florida in detail below.

·       Step # 1: Understanding Limited Liability Structure

To form an LLC in Florida you first need to understand what a limited liability structure is. A limited liability company is actually a hybrid business having all the positive aspects of the business structure. Having the LLC, you will get to enjoy the flexibility of partnership and tax efficiency of the corporation.

Moreover, the limited liability structure will permit you to have all the positive aspects including the ease of sharing profits and losses, limited liability, and the convenience of record-keeping. Along with these positive aspects, there is only one drawback, the owners or partners have to pay the taxes on their own.

·       Step # 2: Creating Structure For Your Business

Thinking of how to form an LLC in Florida, you should know the structure you wish to create for your business. By creating a structure we mean that you have to decide whether your limited liability company will be managed by managers or by members. Members are actually the owners of the company.

To know how to form an LLC in Florida you must first understand that it is essential to write in the Articles of Association about the structure of your business. If you do not mention or specify it, the law will assume that your company is managed by members or partners of the Limited Liability Company.

If you are willing to explore how to form an LLC in Florida, you also need to understand that a Limited Liability Company managed by members is the company where the members are permitted to make decisions and have the management authority of running the day to day operations of the business.

According to experts, this is a great option so if you are willing to start an LLC and asking how to form an LLC in Florida, then you should opt for member managed LLC as it does not require any separate management levels and everyone is given equal authority. On the contrary, when the company is managed by managers, only the managers are permitted to decide the day to day tasks and operations while the members have no authority to decide but only look over the workings of the managers and be passive investors.

·       Step # 3: Choose a Name for Your Business and Principal Office

If you are interested to know how to form an LLC in Florida then choosing a name for your business is one of the most important requirements. Do some research and then choose a legal and appropriate name for your limited liability company. The name of the company should be decided by checking the Department of State so that there are no clashes in the business name.

Additionally, you will have to add Limited Liability Company, ltd., or LLC in the end of the name. When you are done choosing a name, it is time to designate a head office to include in the Articles of Association to prove its existence with the street address and mailing address.

·       Step 4: Find a Registered Agent and Draft Articles of Association

If you wish to know how to form an LLC in Florida, then keep in mind that you would require a registered agent by law in Florida. Without a registered agent in Florida, you will not be able to form your business smoothly. They must be an individual or an entity residing in Florida only. Also, they must have a proper street address i.e. office in Florida to receive and send the notices, proceeds, and conduct processes for the company.

Once you found a credible registered agent, it is time to draft Articles of Association. In this document, your registered agent will help you in writing the name of the business, mailing address of the office, address and name of the registered agent themselves and other important company information. When you are done writing it, you need to get it signed by at least one person who is acting as the authorized representative for your Limited Liability Company. Normally, the representative is the registered agent only so you can get it signed by them.

·       Step # 5: Deliver Documents and Pay Filing Fee

Once the documents are completed, you can deliver it. Also, you will have to pay filing fee for the Articles of Association. If you wish to form an LLC in Florida, then you should remember that you will have to pay $100 as a filing fee for the certificate and $25 to the registered agent, which sums up to $125 to properly deliver the documents. All those concerned about how to form an LLC in Florida, can be happy on the day of filing, because once they file the documents, the same day their Limited Liability Company will be formed.

How to Get an EIN Number to Sell on Amazon

Individuals who believe that it's important to have an SSN or ITIN to obtain an EIN are wrong. Having an ITIN or SSN is not necessary, but there are 4 factors that should be noted.

To get an EIN to sell on Amazon visit www.itinnumberonline.com

  1. The corporation's structure such as C-Corporation, S-Corporation or LLC.

  2. A person's status; U.S. resident or a non-U.S. resident.

  3. The co-founders of the business who are U.S.-based.

  4. The association of a business with a U.S. accountant or attorney.

The factors above will help you determine whether or not an SSN or ITIN is needed for an EIN. It's not a criterion for individuals to acquire an SSN or ITIN for an EIN. Hence, Amazon sellers who are worried about how to get an EIN number to sell on Amazon should go through the following information.

Recently, the IRS has implemented certain policies which make it quite complicated for persons to acquire an EIN. This is also true for foreign businesses, even if they possess an ITIN or SSN. To make an EIN easier for businesses without an ITIN or SSN, they need to comprehend  the EIN application process.

  1. Foreign businesses require a credible US-based business lawyer with a valid SSN who can act as their third party designee to represent their business.

  1. The credible business lawyer hired by you for your business has to ready an application for an 'Employer Identification Number' (EIN) with the required documentation on your behalf.

  1. After preparing the application, the business lawyer must contact the IRS for international applicants and will have to send the signed form to the IRS through fax.

  1. As soon as the application will be accepted by the IRS, your business lawyer must receive the 'Employer Identification Number' for the foreign business on the same day, provided the name of the lawyer has been mentioned in the third party designee portion of the application form.

In short, to get an EIN without an SSN or ITIN, you must hire a professional, accredited, and credible US-based business lawyer. An experienced and certified lawyer is an integral part of the EIN application process and they help in securing an EIN efficiently and effectively.

Without a good lawyer, the EIN process might not go smoothly as they are the ones who either have an SSN or ITIN which becomes the base to obtaining an EIN for your business as they are representing you. Therefore, you should select your business lawyer properly and you should ensure they possess an SSN or ITIN.

What is an IRS 1035 Exchange

What is an IRS 1035 ExchangeIf you want to learn the core of what is a 1035 exchange, then read this section very carefully. The section 1035 exchange is basically a tax free exchange of life insurance policy or an annuity contract for a new one. If you are concerned about what a 1035 exchange is, then you should also keep in mind that you can only qualify for the section 1035 exchange for a new contract when the policy holder exchanges the existing contract in return for the new contract. In this case, the annuitant and the policy holder should be the same.

For information about 1035 exchange go to www.freedomtaxaccounting.com

Furthermore, section 1035 exchange is actually a provision of the United States tax code which gives the ability to transfer funds from an annuity, endowment or life insurance policy to a policy of a similar type. When the funds are transferred from the old to the new policy, the exchange can occur under section 1035 without any taxes.

Now that you have understood what a 1035 exchange is, you should also know that with this life insurance policy, you will be able to transfer your funds for putting off any gains. For example, if you transfer all the proceeds from an old policy to the new one, no taxes will be levied on the gain of the original policy at the time of transfer if there are no outstanding loans on the original policy. On the contrary, if the gains from the policy are transferred without using the 1035 exchange, they will be taxed at the ordinary income tax rates of the policy holder.

All those asking what a 1035 exchange is, they should remember that even if a policy does not have any gains, they will be advantageous no matter what. With 1035 exchange insurance, policy holders can avoid paying more taxes than required by the federal laws, like in a modified endowment contract. Also, when policy holders like paying future premiums for a new policy, the 1035 exchange can be helpful at that time as well. This lets individuals enjoy purchasing a new policy without having to pay more money.

Moreover, even when there are no gains to be deferred, section 1035 exchange still permits a policy holder to preserve their basis. For instance, if the cash value of the original policy is higher than the gross value, this means that an individual is suffering losses. But, a 1035 exchange helps policy owners enjoy the higher basis of the new contract. The original contract's tax basis becomes the new contract basis in this scenario.

Tax Planning For Chinese Investors in the U.S. Real Estate Market

Tax Planning For Chinese Investors in the U.S. Real Estate Market

Better Tax Planning for Chinese Investors

Description: 57e396007acb9.jpgThe main issue that Chinese investors face when investing money in the US real estate market is the direct investment which is subject to Foreign Investment in Real Property Tax Act (FIRPTA), also known as Section 897. What this section basivcally proposes is that any gain earned by a foreign investor on any US real estate property will be treated as any other gain earned by a resident on any US business or trade transaction. The amount of  taxes paid by the foreign investor would be similar to that paid by a citizen and filing of US federal and state income tax returns would be done in the same manner as well.

Here is what the Chinese investors can do to improve their tax planning when investing in American real estate:

If you are a foreign investor in U.S. real estate, and need tax planning advise, please call us at 407-344-1012, or email us at info@freedomtaxfl.com. Or visit www.freedomtaxaccounting.com

Invest as a Lender

You can make a smarter move by investing in USA's booming real estate as a lender instead of as a partner in property holding corporations. This can give you a chance to have the loan secured. The collateral does not make it a US real property interest and, hence, a non-participating loan is not subjected to FIRTPA regulations. Investors can also save FIRPTA taxation on an appreciation loan as a US real estate property is not liable under it when it comes to interest and principal amount. If the loans are deemed as debt for US federal income tax purposes, then these strategies can effectively give way for a lesser taxed investment and allows foreign investors to be a part of US real estate market

The taxation would be done in a manner which is the same as it is done when normally levied on other US property interests. A loan, by principal, is considered US real estate property interest if it participates or shares in the appreciative process of a property. If the interest is further qualified as a portfolio investment and the foreign investor is defined, they will be exempted under Code Section 892 in case of foreign government and the US tax Treaty, whichever is applicable.

Foreign Investment as Offshore Blocker

Another option Chinese investors can choose to take to lessen their tax burden is to invest as a shareholder in a domestic corporation as well as a lender to it instead of stepping into the real estate market as an equity investor. This way, your funds will be indirectly invested into the US real estate fund or the US real estate itself by the domestic corporation.

Real Estate Investment Trusts

Description: 57e3974f4e4a2.jpgReal Estate Investment Trust, or (REIT) in short, is a corporation that either owns or finances real estate properties that produce income. They can be a considerable option in case of tax planning for Chinese Investors. They are a good means to reduce US federal income taxation to a minimum or to completely avoid it. Once an REIT meets the requirements of tests, like asset, total income, nature of ownership and distribution, it can evade US federal income taxes which might otherwise be levied on foreign investors even though it itself would be seen as a corporation. Apart from a few exceptions, the rest of the profits from REITs will be subjected to FIRPTA laws.

If the ownership of a foreign investor in publicly traded REIT is at 5% or below, it will not be taxed according to FIRPTA regulations. They will be taxed under the regular conditions as there are for residents. The condition is also the same with 0% withholding and a period of one year calculated from the date of confirmation of the contract till the distribution date.

An REIT that has 50% of the share of stock in the name of resident owners would also be exempted from FIRPTA taxations under two conditions. These two conditions are;

  1. Five year period that comes to an end on the date of the transaction in question

  2. The period of existence of REIT

Among these two conditions, whichever is the shortest will be considered. This case of 50% ownership by US residents is called “domestically controlled” status.

Many foreign investors can also have their taxes exempted if they use private REITs as a holding unit. Though the US tax-exempt investors are able to obtain benefit from the fractions rule as well as the firm's qualification under such a norm, they are not subjected to FIRPTA taxations.

What companies or funds might do is that they may acquire US real estate interests and hold them under REIT. This would attract foreign investors, in this case, Chinese investors. Furthermore, such an investment can be ended by the sale of the REIT by the fund holding party.

However, it must be noted that any sale of US real estate interest by the REIT will be subjected to FIRPTA taxations for non-US investors without any difference, whether the REIT has the status of being domestically controlled or non-controlled.

IRS ITIN Tax Number For Amazon Sellers

IRS ITIN Tax Number For Amazon SellersOnce you have understood the benefits and have fulfilled the eligibility requirements of obtaining an ITIN, you can submit the application for it either through mail, in-person or through an IRS acceptance agent. Whichever method you choose, the procedure of submission will remain the same. If you have decided to apply for an ITIN number for Amazon sellers, then here's how you proceed.

For help applying for your ITIN number call 407-344-1012 or visit www.itinnumberonline.com

1.    Through Mail

Firstly, ITIN applications cannot be submitted on the internet. Download and print the latest version of the W-7 form from the official website of the IRS. There are 8 boxes from 'a' to 'h' and you need to tick the correct box or boxes, to explain the reason for which you are submitting the W-7 form.

As a general rule check the boxes 'b', 'c', 'd', 'e', 'f' or 'g' on the W-7, because you will be filing for a federal tax return as well. The W-7 records your biographical information. Non-resident aliens who are filling the W-7 should check the boxes 'a' and 'h' for tax treaty benefits.

If you fill the W-7 incorrectly or check the wrong boxes, you might get a temporary ITIN number for Amazon sellers. So make sure you fill the W-7 form correctly and attentively. Here is a brief explanation for what each box means. However, do not leave any section of the form blank; write down 'NA' (Not Available) for any field which is not applicable to you.

  • Box 'a' is for a non-resident alien who wants to get an ITIN in order to claim a tax treaty benefit. This is valid for the residents of those countries with whom the U.S. has an income tax treaty. If you are going to check this box, make sure to check box 'h' as well.

  • Box 'b' is for a non-resident alien who will be filing a tax return. This tax is compulsory to notify the IRS of an income, which is being generated from a business or a trade in the U.S. This box is also checked if only a tax refund is required.

  • Box 'c' is for those non-resident aliens who have been living and working illegally in the U.S. Although the USCIS has not given them permission to work, such individuals are still required to file a tax return.

  • Box'd' is for the dependents of a U.S. citizen or U.S. resident alien. These individuals are not eligible to receive an SSN. The dependents of U.S. military personnel are not required to submit an original or certified copy of their identification document though.

  • Box 'e' is for the spouse of a U.S. citizen or resident alien. The spouse may or may not be a resident alien and is ineligible for an SSN, but who is not subject to filing a tax return. The alien can also choose to file a U.S. tax return in a joint effort with their spouse. In such cases, this box needs to be checked.

  • Box 'f' is for a non-resident alien professor, student or researcher who has temporarily come to the U.S. to teach at a recognized educational institution, to attend a course or degree or to carry out research. If this box is being checked, you need to submit your passport with a valid U.S. visa.

  • Box 'g' is for the spouse or dependent of a person holding a valid U.S. visa. Such individuals are dependent on a tax return, but are not eligible to get an SSN. They have entered the U.S. with a non-resident person holding a U.S. visa. When checking this box, make sure to attach a photocopy of your visa with the W-7 form.

  • Box 'h' is for situations that have not been described in the previous boxes. If any of the reasons mentioned through box 'a' to 'g' are not applicable to you, check this box and describe your reason in detail for requesting an ITIN. Remember to attach supporting documentation as well.

Afterwards, you need to attach a valid federal tax return to the W-7 application along with a set of supporting documents such as your genuine proof of identity like a valid passport or certified copies of the like. Furthermore, since you are an Amazon seller, you will also need to provide an official letter by Amazon for the purpose of an ITIN. You can request for the letter by contacting Amazon directly.

Please note that the IRS does not accept notarized copies of the passport anymore for the application of an ITIN number for Amazon sellers; instead, you have to submit copies of your identifying documents which have been certified by the issuing agency of the IRS.

The IRS also accepts original identification documents and has released a list of 13 documents that are accepted. These documents will be returned within 60 days of processing the W-7 form. The documents are listed below.

  • A stand-alone passport

  • Civil birth certificate (For dependents under 18 only)

  • Foreign driver's license

  • National identification card (Name, Date of birth, Address, expiration date, and Photo must be visible)

  • U.S. State identification

  • U.S. military identification card

  • U.S. driver's license

  • Foreign military identification card

  • Foreign voter's registration card

  • Medical records (For dependents under 6 only)

  • Visa

  • USCIS photo identification

  • School records (For dependents under 14 only, under 18 if a student)

You can then mail the completed application to the IRS. Since you are mailing your tax return form as an attachment to the W-7 form, don't send it to the address listed in the form 1040A, 1040 (the tax return form; also known as the U.S. Individual Income Tax Return), or 1040EZ.

Instead, mail the W-7, the tax return form, and the original or certified copies of your identification and foreign status documents to this address:

Internal Revenue Service

Austin Service Center

ITIN Operation

Austin, TX 78714-9342

P.O. Box 149342

An application for the ITIN number for Amazon sellers can be made anytime during the year as there is no restriction. However, you have to ensure the tax return is filed before its due date; otherwise, you might be liable to pay a penalty.

Once your application is received, it will be verified and if you are eligible for an ITIN, a letter will be issued by the IRS containing your ITIN within a period of six weeks. If you don't receive a letter within the allotted time, you can call the IRS hotline for information on your application status.

How to Get Credit Card With ITIN

How to Get Credit Card With ITIN

A lot of people in the United States who are ineligible for a social security number want to know how they can get a U.S bank issued credit card. There are a few ways to get a credit card without an SSN number. However, the easiest and safest way is using an ITIN number. Therefore, knowing how to get credit card with ITIN number is important. However, before we find out how to get credit card with ITIN number, let' see what social security number is and why it's important.

Your basic information such as your name, employment status, phone number, and U.S address is what a typical credit card application would require. The application would also ask for a United States social security number (SSN). Provided you meet bank requirements, social security number will make you eligible for credit cards in the U.S.

Generally, U.S citizens are assigned social security numbers shortly after they're born. When you work, social security numbers are used to keep track of your earnings for tax purposes. Furthermore, the credit history of most people is tied to their social security number. This means that a social security number allows a lender to see whether someone pays bills on time and the amount of debt he or she has.

Not considering political asylum seekers and refugees, foreigners living in the United States aren't automatically given social security numbers. For example, a social security number may not be issued to a foreigner who's attending school or working in the United States under a worker, student, or immigrant visa. The same is applicable for individuals with a green card who are not yet permanent residents.

Although it can cause inconvenience, not having a social security number does not prevent you from obtaining a credit card. If you are living in the United States and don't have a social security number, you can still apply for a credit card and obtain it. How? There are a few ways to do it. However, our focus is on the 'commonly used' and 'best' way to get a credit card without a social security number and that way is using ITIN number. So how to get credit card with ITIN number? Let's take a look.

Available to anyone who isn't eligible for a social security number, ITIN is issued by the Internal Revenue Service for tax purposes. How to get credit card with ITIN number? Financial institutions such as banks use ITIN to keep track of your credit history. In more many ways, an ITIN works just like a SSN. However, there is one major difference-you can obtain an ITIN regardless of your immigration status which is not the case with a SSN.

Today, there are many financial institutions that do not process a credit card application unless and until the applicant provides them his or her social security number. However, there are also some financial institutions that accept an ITIN for a credit card application. You already know how you can obtain an ITIN. Therefore, without wasting much time, we will get straight to the point-how to get credit card with ITIN number?

How to get credit card with ITIN number? Before we look into the process, let's take a look at the financial institutions that allow you to apply for a credit card with an ITIN. Following are the banks that allow you to apply for a credit card with an ITIN:

  • American Express

  • Bank of America

  • Capital One

  • Chase

  • Citibank

  • Discover

So how to get credit card with ITIN number? The aforementioned banks will not deny you a credit card on the basis that you do not have a social security number and are applying with an ITIN. However, they have the right to deny you the credit card if you don't have a credit history. It is important for you to keep in mind that you cannot transfer foreign credit to the U.S. Therefore, you'll have to build your credit history from scratch.

How to get credit card with ITIN number? Usually, people applying for a credit card with ITIN have to start with a secured credit card. This type of credit card requires a security deposit. When the card issuer is unable to determine your credit quality, the security deposit neutralizes any risks to them. The credit line that the card issuer will provide you will be equal to your security deposit.

The collateral for a traditional loan and the security deposit for a secured credit card are pretty much the same thing. On the plus side, even if you have no credit history, applications for secured credit cards are almost always approved. You might become eligible for a regular secured credit card if you manage the account responsibly for a year or so. What does managing your account responsibly mean? Managing your account responsibly means using your card responsibly and paying it off in full and on time.

How to get credit card with ITIN number? You will be able to set up a credit profile with the three 'big' credit bureaus once you use an ITIN to open a credit card account. The three bureaus you can build a credit profit with are:

  • TransUnion

  • Experian

  • Equifax

How to get credit card with ITIN number? You cannot transfer any foreign credit history that you may have your United States credit profile. However, you'll eventually set up a credit score if you maintain an efficacious payment history. This in turn will allow you to apply for other lines of credit or loans.

At closing, sellers need to sign a FIRPTA affidavit which states that they aren't a non-resident alien for U.S income taxation purposes. The purpose of the FIRPTA affidavit is to protect buyers.

Often, there is confusion as to who is a foreign person and what exceptions appertain. In order to be exempt from the FIRPTA withholding, the sellers must be either a resident alien with a green card or a United States citizen. When is FIRPTA affidavit required and what happens when it's made available? The buyer is set free from the withholding requirement once the seller provides the buyer a completed FIRPTA affidavit which states that the seller isn't a foreign entity or individual.

When is FIRPTA affidavit required? The seller not being a foreign person is one of the most clear and common FIRPTA exceptions. In such a situation, the buyer must get an affidavit from the seller which states the seller isn't a foreign person. Furthermore, the affidavit should include the seller's:

  • Name

  • ITIN or SSN

  • U.S address

When is FIRPTA affidavit required? The buyer or his or her family must intend to reside at the property for personal purposes for at least half of time for two years immediately after closing if the buyer wants to be eligible for either the reduced rate of withholding or the personal residence exemption.

The buyer may become legally responsible to the IRS for the difference between the amount that should have been withheld and the amount (if any) which was actually withheld in case he or she fails to meet the tenancy requirements. Remember: penalties and interests are included in the amount that should have been withheld. Even if the settlement agent tells the buyer that neither the reduced rate nor the exemption automatically applies or even if the facts do not support the reduced rate or exemption, the buyer isn't required to make this election under the aforementioned exception.

Instead, the buyer must make a favorable election to do the needful if he or she chooses to solicit the reduced rate or the exemption. Imputing the decision of the buyer and (if applicable) the facts entitling the buyer to the reduced rate or exemption, this election should be disposed of as an affidavit.

If you need help completing form 8288 for IRS call 407-344-1012 or visit www.freedomtaxfl.com

Part 1

You cannot fill out a form without understanding its appropriate process. Many times, people hire accounting professionals and lawyers in US to fill their tax forms, which is undoubtedly a wise approach to avoid the penalties. However, you can also save money along with avoiding these penalties simply by evaluating the process of filling tax forms.

  1. The first step is to determine your tax status. If you are operating as a joint corporation in US then you need to request your partners to fill the form 8288 for interests. If you are operating as an individual owner then you may proceed. An ideal approach is to arrange a meeting with your partners and discuss about the division of interest. It is important to make sure that you are not deprived of your due profits when the interests are distributed. Remember that if you fail to establish consent upon one agreement, the authorities will distribute the interest equally among all parties. Now, if your capital investment was more than the equal share of interest, you will receive lesser amount in interest profits.

  2. The second step is to determine the form, which you need to file. We have provided detailed understanding of the form 8288, 8288-A and 8288-B. Sometimes, you need to submit a copy of Form 8288-A along with the Form 8288.

  3. Finally, find a lawyer or accounting professional who offers free consultation services. You can get in touch with the lawyer to evaluate more about your status and form requirement. Many times, the lawyers guide their clients about which form they need to submit, only when the client seems well-versed with the process. This is what you have to prove there. Your role in the process of how to complete form 8288 as a transferee completes here.

Part 2

In this part, we will discuss about the process of completely filling the form 8288. Generally, form 8288 comes in one-page only. However, you may need to attach a copy of Form 8288-A with the form 8288.

If you are wondering about how to complete form 8288 then here we have provided a classification of its parts. The form 8288 consists of two parts. The first part is to be filled by the buyer or transferee under Section 1445 (a). As we have mentioned earlier, a transferee is the buyer or person who receives the property in exchange or gift, or the one who buys a property.

First Part

  1. In the first part you will write your full name in block letters. Sometimes, more than one or two persons buy the property. All transferees will receive their individual forms 8288 and fill them. All transferees will mention their names in this section and write their ITINs in front of the forms. According to 2003 revised tax laws, the IRS allows individuals to submit their forms 8288 without ITIN. However, you will need an individual identity from the IRS to fill this form, if you do not have the ITIN.

  2. In the second section, you will write the individual address and the street number. Do not write the PO Box number in this part.

  3. In the third part, you will write the individual city, town, province, state, and country name. Make sure to write your personal addresses and not of the company. This is important because sometimes, the transferees are from different cities, and sometimes they are from different countries. You can also write your phone number for quick access in the box given in the front of address bar. However, phone number is not compulsory to give.

  4. In the fourth section, you will write describe the location of the property, which you have acquired, purchased, or received as a gift or exchanged. Make sure to provide a descriptive explanation of the property's location. Avoid writing the exact address of the property here however, you may explain the street location.

  5. The next section on how to complete form 8288 contains boxes for Date of Transfer. Fill the next box if you have attached Form 8288-A with the form. If you have attached more than one form 8288-A with the form 8288, then make sure to mention the correct number of forms attached. Write down the amount or capital realized at the time of transfer. If you are more than one transferees then you may communicate with each other to write the amount realized at the time of transfer. It will help you to avoid any figurative complication in future.

  6. The next section contains the amount withheld. Make sure to check the correct boxes. You may contact an accounting professional to calculate the withholding amount. Make sure to communicate with other transferees before checking the boxes.

  7. Finally, you will write the amount withheld in the box with number 7. The first part of how to complete form 8288 completes here. Now we will proceed to the second step.

Second Part

The transferee will not fill the second part. Instead, the Entity Subject to the Provisions of Section 1445(e) will fill this part. We have explained this entity earlier in the article. For further information, you can visit the official website of IRS or consult an accounting professional.

The second part contains similar information as is required in the first part. You job completed after signing the form and entering the date.

The last boxes in the form contain information of the preparer. This is useful if you have filled the form using foreign aid like an accounting officer or an agent. The agent will fill their personal information in the Preparer's section. If you have prepared the form yourself, then you will enter your personal information here.

needs a legit Taxpayer Identification Number (TIN). Your individual TIN, Social Security number, and Employer Identification Number, all can serve in its place, and can be used in the application process.

To get an EIN Number for your business, call 407-344-1012, or visit www.itinnumberonline.com or www.freedomtaxfl.com

Apply Through Fax

Taxpayers can always fax completed SS4 applications to the right fax number with the Internal Revenue Service. Before submitting the form, make sure that it has all the required details. It is through this processing that the IRS will determine if the entity really needs a new EIN, and if it does one will be assigned to it. It is very much convenient if the applicant sends in their own fax number, with that the EIN is issued in no more than four working days, if not it can take as much as two weeks to get your business's EIN.

Apply through Mail

The standard time frame for processing an EIN application from the start is a month. This is why the IRS continuously urges that the applicants send in all the necessary information so as not to delay the process. The processing period here takes into account checking whether you need an EIN, before working towards issuing one. For this you will have to mail the SS4 form available with the IRS.

International Applicants Can Apply Through Phone

An international applicant can always call the Internal Revenue Service on weekdays and obtain the EIN for their business. The person who is making the call must be authorized to receive the EIN and be able to answer all questions that concern the SS4 form. In this application form it is important that you complete the Third Party Designee section. You must only do this if you want to authorize a named individual to get the organization's EIN, and also be the one to answer questions regarding the SS4 form.  The authority of the designee is terminated when the EIN is released to said designee, upon their valid signature.

Answering the Questions that Get You the EIN

Applicants for the EIN are presented with five questions during the procedure. The first question requires that you choose the type of EIN you need for the type of your business. Remember that EIN's apply to LLC, estate, partnership, and sole proprietorship. This is really simple; you have to pick the option that you believe describes everything that you are looking to gain from the EIN. You might be working to build a new business, need the EIN for a certain bank you deal with etc. The online questionnaire that you must fill requests that you input your Social Security number before finishing the application.

Saving the Document with EIN

When you have completed all of the parts of your application, the system generates a new EIN for you which you can start using immediately. An official IRS document then loads on your computer, and this is the confirmation that you application was a success. You are then assigned your EIN. A wise move would be to save one copy and print another for your own records just in case you need it while you are around either of those two places.

Remember once you finalize the application and you receive your EIN, you can never have the number you have been issued cancelled. On the other hand, in case you discover that you do not really need an EIN after all, you can request the Internal Revenue Service to close your business account. Remember that your EIN is never cancelled, and is still available to the business owners because the IRS never reassigns a number that has been issued once. You can open the account by requesting it to the IRS any time you want.
